The support referred to in article L. 5131-3 may also take the form of intensive support: the youth commitment contract, drawn up with the young person and tailored to his or her needs as identified during a diagnosis.
The youth commitment contract is a right open to young people between the ages of sixteen and twenty-five, or, by way of derogation from article L. 5131-3, twenty-nine if they are recognised as a disabled worker, who are experiencing difficulties in accessing long-term employment, who are not students and who are not in training. The scheme is subject to compliance with the commitment, attendance and motivation requirements set out in the regulations.
It is implemented by the bodies mentioned in article L. 5314-1 and by Pôle emploi. It may also be implemented by any public or private body providing services relating to the placement, integration, training, support and maintenance in employment of people seeking work.
A monthly degressive means-tested allowance is granted, from the date of signature of the contract, to young people living outside their parents’ home or within their parents’ home without receiving financial support or receiving only limited financial support from their parents. This allowance cannot be transferred or seized. It is not subject to income tax or to the contributions provided for inarticle L. 136-1 of the Social Security Code and chapter II of order no. 96-50 of 24 January 1996 relating to the repayment of the social debt.
A decree sets the amount of the allowance and the conditions under which the young person’s resources are taken into account in determining it. This amount takes into account the age and situation of the young person and the level of financial support he or she receives from his or her parents.
