In public establishments for inter-municipal cooperation, the chairman may decide that the council meeting is to be held in several places by videoconference.
When the Council meeting is held by videoconference, the quorum is determined on the basis of the presence of councillors at the various videoconference locations.
Voting may only take place in the presence of a majority of councillors.
Votes may only be taken by public ballot. If a request for a secret ballot is adopted, the Chairman will postpone the agenda item to a later meeting, which may not be held by videoconference. The public ballot may be organised either by roll call or by electronic ballot, under conditions that guarantee its sincerity. In the event of a tie, the Chairman has the casting vote. The Chairman shall announce the result of the vote, which shall be recorded in the minutes together with the names of those who voted.
Council meetings may not be held in more than one place by videoconference for the election of the Chairman and the officers, for the adoption of the initial budget, for the election of delegates to public inter-municipal cooperation bodies, or for the application of article L. 2121-33. The Council meets in the same place at least once every six months.
When the entire Council meeting is held in the same place, the Council is entitled to vote.
When the Council meeting is held in whole or in part by videoconference, it is broadcast live to the public on the website of the public establishment for inter-communal cooperation. Where premises are made available by the public establishment of inter-communal cooperation for the holding of one of its meetings by videoconference, each of them is accessible to the public.
Where the council meeting is held entirely or partially by videoconference, it is broadcast live to the public on the internet site of the public establishment of inter-communal cooperation.
When the Council meeting is held in whole or in part by videoconference, this fact is mentioned in the notice of meeting provided for in article L. 2121-10.
