Article L5211-25-1 of the French General Code of Local Authorities

In the event of withdrawal of the competence transferred to a public establishment of inter-municipal cooperation:

1° The movable and immovable assets made available to the establishment benefiting from the transfer of competence are returned to the communes previously competent and reintegrated into their assets at their net book value, with the additions made to these assets liquidated on the same basis. The balance of the outstanding debt transferred relating to these assets is also returned to the municipality that owns them;

2° The movable and immovable assets acquired or created after the transfer of competencies are divided between the municipalities that take over the competency or between the municipality that withdraws from the public inter-municipal cooperation establishment and the establishment or, in the specific case of a syndicate whose statutes allow it, between the municipality that takes over the competency and the syndicate of municipalities. The same applies to the proceeds from the sale of such assets. The balance of the outstanding debt contracted subsequent to the transfer of responsibility is divided under the same conditions between the communes that take over the responsibility or between the commune that withdraws and the public establishment for inter-municipal cooperation or, where applicable, between the commune and the syndicate of communes. In the absence of an agreement between the deliberative body of the public inter-municipal cooperation body and the municipal councils of the municipalities concerned, this distribution is set by order of the representative(s) of the State in the department(s) concerned. This decree is issued within six months of the referral to the State representative(s) in the department(s) concerned by the deliberative body of the public inter-municipal cooperation establishment or of one of the municipalities concerned.

The contracts are executed under the previous conditions until they expire, unless the parties agree otherwise. The substitution of a legal entity for contracts concluded by public establishments of inter-municipal cooperation does not entail any right to termination or compensation for the co-contractor. The public establishment of inter-municipal cooperation which returns the competence informs the co-contracting parties of this substitution.

En cas de retrait de la compétence transférée à un établissement public de coopération intercommunale :

1° Les biens meubles et immeubles mis à la disposition de l’établissement bénéficiaire du transfert de compétences sont restitués aux communes antérieurement compétentes et réintégrés dans leur patrimoine pour leur valeur nette comptable, avec les adjonctions effectuées sur ces biens liquidées sur les mêmes bases. Le solde de l’encours de la dette transférée afférente à ces biens est également restituée à la commune propriétaire ;

2° Les biens meubles et immeubles acquis ou réalisés postérieurement au transfert de compétences sont répartis entre les communes qui reprennent la compétence ou entre la commune qui se retire de l’établissement public de coopération intercommunale et l’établissement ou, dans le cas particulier d’un syndicat dont les statuts le permettent, entre la commune qui reprend la compétence et le syndicat de communes. Il en va de même pour le produit de la réalisation de tels biens, intervenant à cette occasion. Le solde de l’encours de la dette contractée postérieurement au transfert de compétences est réparti dans les mêmes conditions entre les communes qui reprennent la compétence ou entre la commune qui se retire et l’établissement public de coopération intercommunale ou, le cas échéant, entre la commune et le syndicat de communes. A défaut d’accord entre l’organe délibérant de l’établissement public de coopération intercommunale et les conseils municipaux des communes concernés, cette répartition est fixée par arrêté du ou des représentants de l’Etat dans le ou les départements concernés. Cet arrêté est pris dans un délai de six mois suivant la saisine du ou des représentants de l’Etat dans le ou les départements concernés par l’organe délibérant de l’établissement public de coopération intercommunale ou de l’une des communes concernées.

Les contrats sont exécutés dans les conditions antérieures jusqu’à leur échéance, sauf accord contraire des parties. La substitution de personne morale aux contrats conclus par les établissements publics de coopération intercommunale n’entraîne aucun droit à résiliation ou à indemnisation pour le cocontractant. L’établissement public de coopération intercommunale qui restitue la compétence informe les cocontractants de cette substitution.
