Article L5211-36 of the French General Code of Local Authorities

Subject to the provisions specific to them, the provisions of Book III of Part Two are applicable to public establishments for inter-municipal cooperation

However, articles L. 2312-1 and L. 2313-1 only apply to public establishments for inter-communal cooperation which include at least one commune of 3,500 inhabitants or more. When the public establishment for inter-municipal cooperation has more than 10,000 inhabitants and includes at least one municipality of 3,500 inhabitants or more, the report on the budget guidelines provided for in the second paragraph of article L. 2312-1 includes the presentation mentioned in the third paragraph of the same article L. 2312-1. This report must be sent to the member municipalities of the public establishment for inter-municipal cooperation.

The places where it is made available to the public are the head office of the establishment and the town halls of the communes that are members of the public establishment for inter-municipal cooperation.

Sous réserve des dispositions qui leur sont propres, les dispositions du livre III de la deuxième partie sont applicables aux établissements publics de coopération intercommunale

Toutefois, les articles L. 2312-1 et L. 2313-1 ne s’appliquent qu’aux établissements publics de coopération intercommunale qui comprennent au moins une commune de 3 500 habitants et plus. Lorsque l’établissement public de coopération intercommunale compte plus de 10 000 habitants et comprend au moins une commune de 3 500 habitants et plus, le rapport sur les orientations budgétaires prévu au deuxième alinéa de l’article L. 2312-1 comporte la présentation mentionnée au troisième alinéa du même article L. 2312-1. Ce rapport est obligatoirement transmis aux communes membres de l’établissement public de coopération intercommunale.

Les lieux de mise à la disposition du public sont le siège de l’établissement et les mairies des communes membres de l’établissement public de coopération intercommunale.
