Article L5211-40-2 of the French General Code of Local Authorities

Municipal councillors of member municipalities of a public inter-municipal cooperation establishment who are not members of its deliberative body are informed of the affairs of the establishment that are the subject of deliberation.

They receive a copy of the notice sent to the community councillors or to the members of the trade union committee before each meeting of the deliberative body of the public inter-communal cooperation establishment, accompanied, where applicable, by the summary explanatory note mentioned in the first paragraph of article L. 2121-12. They are also sent the reports mentioned in the second paragraph of article L. 2312-1 and the first paragraph of article L. 5211-39 as well as, within a period of one month following each meeting, the list of resolutions examined by the deliberative body of the public establishment for inter-municipal cooperation and, within a period of one month following the meeting during which it was adopted, the minutes of its meetings.

If the conference of mayors expresses an opinion on a proposal, it is obliged to submit it to the mayors’ conference.
If the conference of mayors issues opinions, these are sent to all the municipal councillors of the communes that are members of the public establishment for inter-communal cooperation.

The documents mentioned in the second and third paragraphs of this article are sent to all the councillors of the communes that are members of the public establishment for inter-communal cooperation.
The documents referred to in the second and third paragraphs of this article are transmitted or made available in electronic form by the public establishment for inter-municipal cooperation.

These documents may be consulted at the town hall of the municipality concerned.
These documents may be consulted by local councillors at their request at the town hall.

This article applies to members of the deliberative bodies of a public establishment for inter-communal cooperation or of a commune that is a member of a mixed syndicate who are not members of its syndicate committee.

Article L5211-40-2

Les conseillers municipaux des communes membres d’un établissement public de coopération intercommunale qui ne sont pas membres de son organe délibérant sont informés des affaires de l’établissement faisant l’objet d’une délibération.

Ils sont destinataires d’une copie de la convocation adressée aux conseillers communautaires ou aux membres du comité syndical avant chaque réunion de l’organe délibérant de l’établissement public de coopération intercommunale accompagnée, le cas échéant, de la note explicative de synthèse mentionnée au premier alinéa de l’article L. 2121-12. Leur sont également communiqués les rapports mentionnés au deuxième alinéa de l’article L. 2312-1 et au premier alinéa de l’article L. 5211-39 ainsi que, dans un délai d’un mois suivant chaque séance, la liste des délibérations examinées par l’organe délibérant de l’établissement public de coopération intercommunale et, dans un délai d’un mois suivant la séance au cours de laquelle il a été arrêté, le procès-verbal de ses séances.

Si la conférence des maires émet des avis, ceux-ci sont adressés à l’ensemble des conseillers municipaux des communes membres de l’établissement public de coopération intercommunale.

Les documents mentionnés aux deuxième et troisième alinéas du présent article sont transmis ou mis à disposition de manière dématérialisée par l’établissement public de coopération intercommunale.

Ces documents sont consultables en mairie par les conseillers municipaux, à leur demande.

Le présent article s’applique aux membres des organes délibérants d’un établissement public de coopération intercommunale ou d’une commune membre d’un syndicat mixte qui ne sont pas membres de son comité syndical.
