The electors of the communes that are members of a public establishment of inter-communal cooperation may be consulted on decisions that the deliberative body or the president of this establishment are called upon to take in order to regulate matters within the competence of the establishment.
At the proposal of all of the mayors of the member communes, or at the written request of half of the members of the deliberative body, the deliberative assembly of the establishment deliberates on the principle and procedures for organising the consultation. In this case, urgency cannot be invoked.
One tenth of the electors registered on the electoral rolls of the communes that are members of the public establishment of inter-communal cooperation may request that the organisation of a consultation on a matter falling within its decision be placed on the agenda of the deliberative body. Each elector may sign only one request for the organisation of a consultation per quarter. The decision to organise the consultation, in accordance with the provisions of the above paragraph, rests with the deliberative body of the public establishment.
The deliberation that decides on the consultation expressly states that this consultation is only a request for an opinion.
The expenses relating to the consultation are borne by the public establishment of intermunicipal cooperation that organises it.
