Article L5211-53 of the French General Code of Local Authorities

Where the appointment of the members of the deliberative body of the public establishment for inter-municipal cooperation, or of the president of the latter, is the subject of a contentious appeal to the administrative court and, if necessary, to the Council of State, no consultation may take place until this appointment has been the subject of a decision that has become final.

Lorsque la désignation des membres de l’organe délibérant de l’établissement public de coopération intercommunale, ou du président de celui-ci, fait l’objet d’un recours contentieux devant le tribunal administratif et, s’il y a lieu, devant le Conseil d’Etat, aucune consultation ne peut avoir lieu tant que cette désignation n’a fait l’objet d’une décision devenue définitive.
