The president is the executive body of the public establishment of intermunicipal cooperation.
He prepares and executes the deliberations of the deliberative body of the public establishment of intermunicipal cooperation. He is the authorising officer for the expenditure and prescribes the execution of the revenue of the public establishment of intermunicipal cooperation.
He has sole responsibility for administration, but may delegate by decree, under his supervision and responsibility, the exercise of part of his functions to the vice-presidents and, in the absence or impediment of the latter or when they are all holders of a delegation, to other members of the bureau. He may also, under his supervision and responsibility, by decree, delegate signing authority to the Director General of Services, the Deputy Director General of Services, the Director General of Technical Services, the Director of Technical Services and the Heads of Service. The delegation of signature given to the Director General of Services, the Deputy Director General of Services, the Director General of Technical Services, the Director of Technical Services and the Heads of Service may be extended to the powers entrusted by the deliberative body to the Chairman pursuant to article L. 5211-10, unless this body has decided otherwise in the deliberation delegating these powers to the Chairman. These delegations subsist until they are withdrawn.
The functions of chairman and vice-chairman are incompatible with those of a member of the military in a position of active service.
Members of the bureau exercising a mandate as a deputy, senator or representative in the European Parliament may not receive or retain delegations.
The chairman is the head of the services of the public establishment of intermunicipal cooperation.
He represents the public establishment of intermunicipal cooperation in legal proceedings.
The president of the public establishment for inter-municipal cooperation appoints rural wardens in the cases and under the conditions provided for in article L. 522-2 of the Code of Internal Security.
The president of the public establishment for inter-communal cooperation may, by delegation from its deliberative body, be responsible for exercising, on behalf of the establishment, the pre-emption rights, as well as the right of priority, which the latter holds or delegates in application of the town planning code. He may also delegate the exercise of these rights on the occasion of the disposal of a property, under the conditions set by the governing body of the establishment. It reports on the exercise of this power at the next useful meeting of the deliberative body.
As from the installation of the deliberative body and until the election of the chairman, the duties of the chairman are performed by the oldest member.
