Article L5212-25 of the French General Code of Local Authorities

When the application of a fiscal or budgetary provision results in an increase or decrease in the operating resources of a commune that is a member of a syndicate by a percentage equal to or greater than 10% of the revenue of the operating section, in the case of a commune with fewer than 20,000 inhabitants, and 5% in other cases, each member commune may request the syndicate committee to amend the rules setting the terms and conditions for the distribution of the communes’ financial contributions to the syndicate’s budget from the following year.

If the syndicate committee has not granted the request within six months, or if the deliberation of the syndicate committee has not been approved by the municipal councils under the conditions provided for in the second, and third paragraphs of Article L. 5211-20, the representative of the State in the département may, at the request of the commune concerned and after obtaining the opinion of the chambre régionale des comptes (regional audit office), amend the rules governing the distribution of the communes’ financial contributions to the syndicate’s budget.

Article L5212-25

Lorsque l’application d’une disposition à caractère fiscal ou budgétaire a pour conséquence d’augmenter ou de diminuer les ressources de fonctionnement d’une commune membre d’un syndicat d’un pourcentage égal ou supérieur à 10 % des recettes de la section de fonctionnement, s’il s’agit d’une commune de moins de 20 000 habitants, et à 5 % dans les autres cas, chaque commune membre peut demander au comité du syndicat une modification des règles fixant les modalités de répartition des contributions financières des communes au budget du syndicat à compter de l’année suivante.

Si le comité du syndicat n’a pas fait droit à la demande dans un délai de six mois, ou si la délibération du comité du syndicat n’a pas été approuvée par les conseils municipaux dans les conditions prévues aux deuxième, et troisième alinéas de l’article L. 5211-20, le représentant de l’Etat dans le département peut modifier, à la demande de la commune intéressée et après avis de la chambre régionale des comptes, les règles fixant les modalités de répartition des contributions financières des communes au budget du syndicat.
