Article L5212-8 of the French General Code of Local Authorities

The decision to establish or an amending decision may provide that the delegates appointed by the municipal councils of the communes that are members of the syndicat shall constitute a college for the election of their representatives to the committee. Unless otherwise provided for in the statutes of the syndicat de communes and notwithstanding 1° of Article L. 5212-16, the representatives thus elected are also entitled to take part in the vote on any matter put to the vote for which at least one municipality represented within the college is concerned.

La décision d’institution ou une décision modificative peut prévoir que les délégués désignés par les conseils municipaux des communes membres du syndicat constituent un collège pour l’élection de leurs représentants au comité. Sauf disposition contraire des statuts du syndicat de communes et par dérogation au 1° de l’article L. 5212-16, les représentants ainsi élus sont également habilités à prendre part au vote pour toute affaire mise en délibération, pour laquelle au moins une commune représentée au sein du collège est concernée.
