I. – In addition to providing the payment services mentioned in II of article L. 314-1, payment institutions may provide related services, such as book-entry foreign exchange services, custody services, data recording and processing, and guaranteeing the execution of payment transactions.
II. – As part of their business of providing the payment services mentioned in 4° and 5° of II of Article L. 314-1, payment institutions may grant credit if the following conditions are met:
a) The credit is ancillary in nature and is granted exclusively in connection with the execution of payment transactions carried out by the payment institution;
b) The credit is repaid within a period agreed by the parties, which may in no case exceed twelve months;
c) The credit is not granted on the basis of funds received or held by the institution with a view to executing payment transactions.
Loans granted by payment institutions are subject to the provisions of the Consumer Code insofar as they are applicable to them.
In accordance with the conditions laid down by an order of the Minister for the Economy, payment institutions must at all times have an appropriate amount of own funds in relation to the total amount of credit granted.
