Article L531-28 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The French Office for the Protection of Refugees and Stateless Persons may decide not to rule under the accelerated procedure, unless the applicant’s presence in France constitutes a threat to public order, public security or State security, as referred to in 5° of article L. 531-27, where it deems this necessary to ensure appropriate consideration of the application, in particular if the applicant from a country on the list referred to in Article L. 531-25 gives serious reasons for considering that his or her country of origin cannot be considered as safe due to his or her personal situation and with regard to the grounds for his or her application.

L’Office français de protection des réfugiés et apatrides peut décider de ne pas statuer en procédure accélérée, sauf si la présence du demandeur en France constitue une menace pour l’ordre public, la sécurité publique ou la sûreté de l’Etat, comme mentionné au 5° de l’article L. 531-27, lorsque cela lui paraît nécessaire pour assurer un examen approprié de la demande, en particulier si le demandeur provenant d’un pays inscrit sur la liste mentionnée à l’article L. 531-25 invoque des raisons sérieuses de penser que son pays d’origine ne peut pas être considéré comme sûr en raison de sa situation personnelle et au regard des motifs de sa demande.
