Article L5312-3 of the French Labour Code

After consultation within the Conseil national de l’emploi, de la formation et de l’orientation professionnelles, a multi-year agreement concluded between the State, the body managing the unemployment insurance scheme mentioned in article L. 5427-1 and the public institution mentioned in article L. 5312-1 defines the objectives assigned to the latter with regard to the employment situation and in light of the forecast resources allocated to it by the body managing the unemployment insurance scheme and the State.

It specifies in particular:

1° The persons who should benefit as a priority from the interventions of the institution mentioned in article L. 5312-1 ;

2° The objectives for improving the services provided to jobseekers and businesses and, in particular, the average number of jobseekers assisted per adviser and the objectives for reducing this ratio;

3° Changes in the territorial organisation of the institution;

3° bis The conditions under which the institution cooperates at regional level with the other players in the public employment service, where appropriate by means of multiannual regional agreements for the coordination of employment, guidance and training;

4° The conditions for the use of private bodies carrying out placement activities as referred to in Article L. 5311-4;

5° The conditions under which the institution’s actions are evaluated on the basis of performance indicators that it defines.

A monitoring committee oversees the application of the agreement and evaluates its implementation.

Article L5312-3

Après concertation au sein du Conseil national de l’emploi, de la formation et de l’orientation professionnelles, une convention pluriannuelle conclue entre l’Etat, l’organisme gestionnaire du régime d’assurance chômage mentionné à l’article L. 5427-1 et l’institution publique mentionnée à l’article L. 5312-1 définit les objectifs assignés à celle-ci au regard de la situation de l’emploi et au vu des moyens prévisionnels qui lui sont alloués par l’organisme gestionnaire du régime d’assurance chômage et l’Etat.

Elle précise notamment :

1° Les personnes devant bénéficier prioritairement des interventions de l’institution mentionnée à l’article L. 5312-1 ;

2° Les objectifs d’amélioration des services rendus aux demandeurs d’emploi et aux entreprises et en particulier le nombre de demandeurs d’emplois suivis en moyenne par conseiller et les objectifs de réduction de ce ratio ;

3° L’évolution de l’organisation territoriale de l’institution ;

3° bis Les conditions dans lesquelles l’institution coopère au niveau régional avec les autres intervenants du service public de l’emploi, le cas échéant au moyen des conventions régionales pluriannuelles de coordination de l’emploi, de l’orientation et de la formation ;

4° Les conditions de recours aux organismes privés exerçant une activité de placement mentionnés à l’article L. 5311-4 ;

5° Les conditions dans lesquelles les actions de l’institution sont évaluées à partir d’indicateurs de performance qu’elle définit.

Un comité de suivi veille à l’application de la convention et en évalue la mise en œuvre.
