Article L532-30 of the French Monetary and Financial Code

An AIFM established in a third country wishing to manage European Union AIFs or to market in the European Union the units or shares of AIFs it manages must first obtain authorisation from the Autorité des marchés financiers when its Member State of reference is France.

An AIF established in a third country, which has not globally delegated its management and which wishes to market its units or shares in the European Union shall apply the provisions relating to managers.

The General Regulation of the Autorité des marchés financiers shall specify the conditions of application of this article.

Un gestionnaire établi dans un pays tiers qui souhaite gérer des FIA de l’Union européenne ou commercialiser dans l’Union européenne des parts ou actions de FIA qu’il gère obtient au préalable un agrément de l’Autorité des marchés financiers lorsque son Etat membre de référence est la France.

Le FIA établi dans un pays tiers, qui n’a pas globalement délégué sa gestion et qui souhaite commercialiser ses parts ou actions dans l’Union européenne applique les dispositions relatives aux gestionnaires.

Le règlement général de l’Autorité des marchés financiers précise les conditions d’application du présent article.
