Article L532-32 of the French Monetary and Financial Code

The AIFM referred to in Article L. 532-30 shall have a legal representative in France. The legal representative is the AIFM’s contact point in the European Union. All official correspondence between the competent authorities and the AIFM and between unitholders or shareholders established in the European Union of the AIF concerned, in accordance with this section, shall take place through this legal representative. It is also the contact point for the European Securities and Markets Authority. It shall verify that the AIFM’s management and marketing activities comply with the provisions in force. It is provided with the necessary resources to carry out these checks.

The General Regulation of the Autorité des marchés financiers shall specify the conditions of application of this article.

Le gestionnaire mentionné à l’article L. 532-30 dispose d’un représentant légal en France. Le représentant légal est le point de contact du gestionnaire dans l’Union européenne. Toute correspondance officielle entre les autorités compétentes et le gestionnaire et entre les porteurs ou actionnaires établis dans l’Union européenne du FIA concerné, conformément à la présente section, a lieu par l’intermédiaire de ce représentant légal. Il est également le point de contact pour l’Autorité européenne des marchés financiers. Il vérifie la conformité aux dispositions en vigueur des activités de gestion et de commercialisation du gestionnaire. Il est doté des moyens nécessaires à l’exercice de cette mission de vérification.

Le règlement général de l’Autorité des marchés financiers précise les conditions d’application du présent article.
