I.-Employees who are fit for work and looking for work, who meet the conditions of age and previous activity, and whose :
1° Either the loss of employment is involuntary, or is treated as involuntary by the agreements relating to unemployment insurance mentioned in article L. 5422-20 ;
2° Or the employment contract has been terminated by agreement in accordance with the terms and conditions set out in articles L. 1237-11 to L. 1237-16 of this Code orarticle L. 421-12-2 of the French Construction and Housing Code;
3° Or the employment contract has been terminated by mutual agreement in accordance with the provisions of articles L. 1237-17 to L. 1237-19-14 of this Code.
If it is established that a jobseeker has twice, in the course of the previous twelve months, refused an offer of a permanent employment contract under the conditions provided for in article L. 1243-11-1, or if it is established that he/she has twice, in the course of the same period, refused an offer of a permanent employment contract under the conditions provided for in article L. 1251-33-1, he may only be entitled to the insurance allowance under 1° of this I if he was employed under an open-ended employment contract during the same period. This paragraph does not apply if the last offer made to the jobseeker does not comply with the criteria set out in the personalised employment access project referred to in Article L. 5411-6-1 if this project was drawn up before the date of the last refusal taken into account.
II – Workers whose voluntary loss of employment is the result of resignation within the meaning of article L. 1237-1, without prejudice to 1° of I of this article, who are fit for work and looking for work and who:
1° Satisfy specific conditions of previous activity ;
2° Are pursuing a professional retraining project requiring training or a project to set up or take over a business. This project must be of a genuine and serious nature, as attested by the regional inter-professional joint committee mentioned in article L. 6323-17-6, under conditions set by decree in the Conseil d’Etat.
