When the health care establishment has a long-term care authorisation mentioned inarticle L. 174-5 of the Social Security Code, the contract provided for in article L. 6114-1 of this Code includes an appendix relating to this activity, co-signed by the President of the Departmental Council.
The failure of the President of the Departmental Council to sign this appendix does not prevent the signing of the multi-year contract of objectives and resources.
For long-term care in establishments authorised to receive social assistance beneficiaries, this appendix is equivalent to the agreement for departmental social assistance provided for in articles L. 313-8-1 and L. 342-3-1 of the Code de l’Action Sociale et des Familles when it is signed by the President of the Conseil Départemental.
When the Regional Health Agency and the Conseil Départemental do not co-sign the appendix, each of these authorities sets the fees for long-term care for the services for which it is responsible.
If the president of the departmental council does not sign the appendix to the contract, the latter will draw up a social assistance agreement with the healthcare establishment that holds a long-term care authorisation and is authorised to receive social assistance recipients.
