Article L6116-2 of the French Public Health Code

Within health establishments and organisations carrying out the tasks of health establishments and medico-social establishments, the control is exercised on the initiative of the Director General of the Regional Health Agency without prejudice to the powers granted to the State representative in the department pursuant to this Code and Book III of the Social Action and Family Code.

Within social establishments, inspections are carried out on the initiative of the representative of the State in the département.

Inspections by members of the Inspectorate General of Social Affairs are carried out on the initiative of the Minister for Health or the Minister for Social Security.

Article L6116-2

A l’intérieur des établissements de santé et organismes exerçant les missions d’établissement de santé et des établissements médico-sociaux, le contrôle est exercé à l’initiative du directeur général de l’agence régionale de santé sans préjudice des pouvoirs reconnus au représentant de l’Etat dans le département en application du présent code et du livre III du code de l’action sociale et des familles.

A l’intérieur des établissements sociaux, le contrôle est exercé à l’initiative du représentant de l’Etat dans le département.

Le contrôle exercé par les membres de l’inspection générale des affaires sociales l’est à l’initiative du ministre chargé de la santé ou du ministre chargé de la sécurité sociale.
