When employed or remunerated exclusively by the professional, the consumer mediator satisfies the following additional conditions:
1° He is appointed, in accordance with a transparent procedure, by a collegiate body set up by the company, comprising representatives of approved consumer defence associations and representatives of the professional, or reporting to a national consultative body in the consumer field or specific to a sector of activity under conditions laid down by decree ;
2° At the end of his term of office, the mediator is prohibited from working for at least three years for the professional who employed him or for the federation to which this professional is affiliated;
3° No hierarchical or functional link between the professional and the mediator may exist during the exercise of his mediation mission. The mediator is clearly separate from the operational bodies of the professional and has a separate and sufficient budget for the performance of his duties.
