Public health establishments may set up one or more hospital foundations, with legal personality, resulting from the irrevocable allocation to the establishment concerned of assets, rights or resources contributed by one or more founders for the purpose of carrying out one or more non-profit works or activities of general interest, in order to contribute to the research or care activities mentioned in article L. 6111-1.
The articles of association of hospital foundations are approved by decree. They define the conditions under which part of the endowment may be allocated to the foundation’s activities.
These foundations have financial autonomy.
The rules applicable to public interest foundations, provided for in particular by law no. 87-571 of 23 July 1987 on the development of sponsorship, apply to hospital foundations subject to the provisions of this article.
The hospital foundation is administered by a board of directors made up of representatives of the founding public institutions. The articles of association may also provide for the presence of qualified individuals. The foundation is subject to supervision by the Director General of the Regional Health Agency.
A decree in the Conseil d’Etat shall determine the terms and conditions for the application of this article.
