Article L621-4 of the French Monetary and Financial Code

I. – (Repealed).

II. – The staff and agents of the Autorité des marchés financiers, its appointed experts and the experts appointed to the Consultative Commissions referred to in III of Article L. 621-2 are bound by professional secrecy under the conditions and subject to the penalties laid down in Article L. 642-1.

This secrecy may not be invoked against the judicial authority acting in the context of either criminal proceedings or receivership or liquidation proceedings instituted against a person referred to in II of article L. 621-9.

III. – The provisions of Chapter VIII of Title II of Book 1 of the Commercial Code are applicable to the members of the Autorité des marchés financiers. No person may be a member of the Autorité des marchés financiers if he or she has been sanctioned under the provisions of this Code during the previous five years.

Article L621-4

I. – (Abrogé).

II. – Les personnels et préposés de l’Autorité des marchés financiers, ses experts mandatés, ainsi que les experts nommés dans les commissions consultatives mentionnées au III de l’article L. 621-2 sont tenus au secret professionnel dans les conditions et sous les peines prévues à l’article L. 642-1.

Ce secret n’est pas opposable à l’autorité judiciaire agissant dans le cadre soit d’une procédure pénale, soit d’une procédure de redressement ou de liquidation judiciaire ouverte à l’égard d’une personne mentionnée au II de l’article L. 621-9.

III. – Les dispositions du chapitre VIII du titre II du livre 1er du code de commerce sont applicables aux membres de l’Autorité des marchés financiers. Nul ne peut être membre de l’Autorité des marchés financiers s’il a été sanctionné au cours des cinq années passées au titre des dispositions du présent code.
