Article L622-3 of the French Intellectual Property Code

The right to the deposit belongs to the creator or his successor in title.

If a deposit has been made in violation of the rights of the creator or his successor in title, the injured party may claim the benefit thereof. The action for reclaiming the rights is barred after five years from the date of publication of the filing.

Le droit au dépôt appartient au créateur ou à son ayant cause.

Si un dépôt a été effectué en violation des droits du créateur ou de son ayant cause, la personne lésée peut en revendiquer le bénéfice. L’action en revendication se prescrit par cinq ans à compter de la publication du dépôt.
