Where a minor apprentice is employed by an ascendant, the apprenticeship contract is replaced by a declaration signed by the employer. This declaration is treated in all respects as an apprenticeship contract.
It includes an undertaking to comply with the conditions laid down in articles :
1° L. 6221-1, relating to the definition and legal status of the contract ;
2° L. 6222-1 to L. 6222-3, relating to the conditions under which the contract is formed;
3° L. 6222-4, relating to the conclusion of the contract ;
4° L. 6222-11 and L. 6222-12, relating to the duration of the contract ;
5° L. 6222-16, relating to apprenticeship contracts followed by open-ended employment contracts;
6° L. 6222-27 to L. 6222-29, relating to pay;
7° L. 6223-1 to L. 6223-8, relating to the employer’s obligations in terms of organising the apprenticeship and training;
8° L. 6225-1, relating to opposition to the hiring of apprentices ;
9° L. 6225-4 to L. 6225-7, relating to suspension of performance of the contract and the prohibition on recruiting new apprentices.
The ascendant pays part of the salary into an account opened for this purpose in the apprentice’s name.
