For seasonal activities within the meaning of 3° of article L. 1242-2, two employers may jointly sign a fixed-term professionalisation contract with any person mentioned in 1° of article L. 6325-1, with a view to acquiring one or, by way of derogation from the same article L. 6325-1, two qualifications mentioned in article L. 6314-1.
A tripartite agreement signed by the two employers and the contract holder is attached to the professionalisation contract. It determines :
1° The assignment of the holder between the two companies during the course of the contract, in accordance with a predefined timetable ;
2° The designation of the employer required to pay the remuneration due in respect of each period devoted by the holder to the actions and courses mentioned in article L. 6325-13 ;
3° The conditions for setting up the tutorship.
The trial period provided for in article L. 1242-10 applies from the start of the first period of actual work with each of the employers.
This contract may be terminated, under the conditions applicable to fixed-term contracts, at the initiative of each of the parties, who shall bear any financial consequences of such termination.
