The professionalisation contract combines general, vocational and technological teaching provided by public or private training bodies or, where the company has a training department, by the company, with the acquisition of know-how through the performance in the company of one or more professional activities related to the qualifications sought. The public or private training bodies mentioned in article L. 6325-2 may not make the enrolment of an employee on a professionalisation contract conditional upon the latter paying a financial contribution of any kind.

The employer undertakes to provide the employee with training enabling him to acquire a vocational qualification and to provide him with a job related to this objective for the duration of the fixed-term contract or the vocational training course under the open-ended contract. The employee undertakes to work on behalf of his employer and to follow the training provided for in the contract.

For each employee on a professionalisation contract, the employer appoints a tutor to provide support. A decree sets out the conditions for this appointment, as well as the tasks and conditions of the tutor’s role.

Holders of a professionalisation contract are not taken into account when calculating the number of employees simultaneously absent on training leave for the application of articles L. 6323-17-1 to L. 6323-17-5.

For seasonal activities within the meaning of 3° of article L. 1242-2, two employers may jointly sign a fixed-term professionalisation contract with any person mentioned in 1° of article L. 6325-1, with a view to acquiring one or, by way of derogation from the same article L. 6325-1, two qualifications mentioned in article L. 6314-1.
