Article L662-7 of the French Commercial code

On pain of nullity of the judgment, the following may not sit on the judgment panels or take part in the deliberation of the proceedings:

1° The president of the court, if he has heard the debtor pursuant to the provisions of Title I of this book;

2° The judge appointed to gather all information on the financial, economic and social situation of the company, for the proceedings in which he has been appointed;

3° The official receiver or, if one has been appointed, his deputy, for the procedures in which he has been appointed;

4° The appointed judge responsible for gathering all information on the debtor’s financial situation, for the professional recovery procedures in which he has been appointed.

A peine de nullité du jugement, ne peut siéger dans les formations de jugement ni participer au délibéré de la procédure :


1° Le président du tribunal, s’il a connu du débiteur en application des dispositions du titre Ier du présent livre ;


2° Le juge commis chargé de recueillir tous renseignements sur la situation financière, économique et sociale de l’entreprise, pour les procédures dans lesquelles il a été désigné ;


3° Le juge-commissaire ou, s’il en a été désigné un, son suppléant, pour les procédures dans lesquelles il a été désigné ;


4° Le juge commis chargé de recueillir tous renseignements sur la situation patrimoniale du débiteur, pour les procédures de rétablissement professionnel dans lesquelles il a été désigné.
