Within two months of publication of the application for registration, an opposition may be filed with the Director General of the Institut national de la propriété industrielle against an application for registration in the event of infringement of one of the following earlier rights having effect in France:
1° An earlier trademark pursuant to 1° of I of Article L. 711-3 ;
2° An earlier trade mark with a reputation pursuant to 2° of I of Article L. 711-3;
3° A name or business name, if there is a risk of confusion in the mind of the public;
4° A trade name, sign or domain name, whose scope is not solely local, if there is a risk of confusion in the mind of the public;
5° A registered geographical indication mentioned in Article L. 722-1 or an application for a geographical indication subject to the approval of its specifications and subsequent registration;
6° The name, image or reputation of a local authority or a public establishment for inter-communal cooperation;
7° The name of a public entity, if there is a risk of confusion in the mind of the public.
An opposition may also be filed in the event of infringement of a trademark protected in a State party to the Paris Convention for the Protection of Industrial Property under the conditions set out in III of Article L. 711-3.
