Article L7224-18 of the French General Code of Local Authorities

The President of the Executive Council brings legal actions on behalf of the territorial collectivity of Martinique by virtue of the decision of the Assembly and may, with the assent of the Executive Council, defend any action brought against the collectivity.

He may, by delegation of the Assembly, be charged for the duration of his mandate with bringing legal actions on behalf of the collectivity or defending the collectivity in actions brought against it, in cases defined by the Assembly. He shall report to the next meeting of the General Meeting on the exercise of this power.

Article L7224-18

Le président du conseil exécutif intente les actions en justice au nom de la collectivité territoriale de Martinique en vertu de la décision de l’assemblée et il peut, sur l’avis conforme du conseil exécutif, défendre à toute action intentée contre la collectivité.

Il peut, par délégation de l’assemblée, être chargé pour la durée de son mandat d’intenter au nom de la collectivité les actions en justice ou de défendre la collectivité dans les actions intentées contre elle, dans les cas définis par l’assemblée. Il rend compte à la plus proche réunion de l’assemblée de l’exercice de cette compétence.
