The representativeness, at the level of the sector in question, of professional organisations of platforms is determined on the basis of the following cumulative criteria:
1° Respect for republican values;
2° Independence;
3° Financial transparency. This criterion is met, in particular, when the trade union or association fulfils the obligations defined in Articles L. 2135-1 to L. 2135-6 ;
4° A minimum of one year’s seniority in the professional field of the platforms mentioned in the first paragraph and at national level. This seniority is assessed from the date of legal filing of the articles of association conferring on the applicant organisation the right to represent the platforms mentioned in the first paragraph in their relations with the employees defined in article L. 7341-1;
5° Influence, which is assessed on the basis of the organisation’s activity and experience in representing the platforms referred to in the first paragraph;
6° Audience, measured every four years, which is assessed taking into account:
a) 30% of the number of employees of the platforms that are members of the applicant organisation in relation to the total number of employees of all the platforms that are members of the applicant organisations in the sector that meet the conditions of seniority and number of services laid down in Article L. 7343-7 ;
b) 70% of the amount of income from the activities mentioned inArticle L. 1326-3 of the Transport Code generated by the platforms that are members of the candidate organisation, in relation to the total amount of income generated by the platforms that are members of all the candidate organisations in respect of the activities carried out by the workers in connection with the platforms in the sector.
For the purposes of calculating the audience, only companies that are up to date with their membership fees are taken into account. The audience resulting from this calculation must be at least equal to 8%.
