Article L741-6 of the French Consumer Code

If the judge finds that the debtor is in the situation referred to in 1° of article L. 724-1, the judge shall order a personal recovery without judicial liquidation, which shall have the same effects as those mentioned in Article L. 741-2.

Debts whose holders have not lodged a third-party objection within a period set by decree are extinguished. However, in this case, debts are stopped on the date of the judgment pronouncing personal recovery without judicial liquidation.

If the judge finds that the debtor is in the situation referred to in 2° of article L. 724-1, the judge shall, with the agreement of the debtor, open personal recovery proceedings with judicial liquidation.

If the judge finds that the debtor’s situation is not irremediably compromised, he or she refers the case to the commission.

S’il constate que le débiteur se trouve dans la situation mentionnée au 1° de l’article L. 724-1, le juge prononce un rétablissement personnel sans liquidation judiciaire, qui emporte les mêmes effets que ceux mentionnés à l’article L. 741-2.

Les créances dont les titulaires n’ont pas formé tierce opposition dans un délai fixé par décret sont éteintes. Cependant, dans ce cas, les dettes sont arrêtées à la date du jugement prononçant le rétablissement personnel sans liquidation judiciaire.

S’il constate que le débiteur se trouve dans la situation mentionnée au 2° de l’article L. 724-1, le juge ouvre, avec l’accord du débiteur, une procédure de rétablissement personnel avec liquidation judiciaire.

S’il constate que la situation du débiteur n’est pas irrémédiablement compromise, il renvoie le dossier à la commission.
