Article L743-13 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The judge may only order the foreign national to be placed under house arrest if he or she has effective guarantees of representation.
The judge may only order the foreign national to be placed under house arrest if he or she has given the original passport and any document proving his or her identity to a police service or gendarmerie unit, in exchange for a receipt valid as proof of identity and bearing a reference to the expulsion decision pending enforcement.
Where the foreign national has previously evaded enforcement of a decision mentioned in article L. 700-1, with the exception of its 4°, special reasons are given for the house arrest.

Article L743-13

Le juge des libertés et de la détention peut ordonner l’assignation à résidence de l’étranger lorsque celui-ci dispose de garanties de représentation effectives.
L’assignation à résidence ne peut être ordonnée par le juge qu’après remise à un service de police ou à une unité de gendarmerie de l’original du passeport et de tout document justificatif de son identité, en échange d’un récépissé valant justification de l’identité et sur lequel est portée la mention de la décision d’éloignement en instance d’exécution.
Lorsque l’étranger s’est préalablement soustrait à l’exécution d’une décision mentionnée à l’article L. 700-1, à l’exception de son 4°, l’assignation à résidence fait l’objet d’une motivation spéciale.
