Article L744-10 of the French Code governing the entry and residence of foreign nationals and the right of asylum

An appeal against a decision handed down by the criminal court may be lodged by the foreign national placed or kept in detention by means of a declaration to the person in charge of the place of detention. This declaration is recorded, dated and signed by the person in charge of the detention centre. It is also signed by the foreign national. If the foreign national is unable to sign, this is noted by the person in charge. The original or a copy of this document is sent without delay to the registry of the court that handed down the contested decision. It is transcribed into the register provided for by, depending on the case, the third paragraph of article 380-12, the fourth paragraph of article 502 or the third paragraph of article 576 of the Code of Criminal Procedure and appended to the document drawn up by the court clerk.

L’appel d’une décision prononcée par la juridiction pénale peut être interjeté par l’étranger placé ou maintenu en rétention au moyen d’une déclaration auprès du responsable du lieu de rétention. Il en est de même du pourvoi en cassation.
Cette déclaration est constatée, datée et signée par le responsable du lieu de rétention. Elle est également signée par l’étranger. Si celui-ci ne peut signer, il en est fait mention par le responsable. Ce document est adressé sans délai, en original ou en copie, au greffe de la juridiction qui a rendu la décision attaquée. Il est transcrit sur le registre prévu par, selon le cas, le troisième alinéa de l’article 380-12, le quatrième alinéa de l’article 502 ou le troisième alinéa de l’article 576 du code de procédure pénale et annexé à l’acte dressé par le greffier.
