Article L752-7 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the decision imposing an obligation to leave French territory, notified prior to the decision of the French Office for the Protection of Refugees and Stateless Persons, has become final, a foreign national who, subsequent to the decision of the Office, is subject to house arrest, or of placement in administrative detention under the conditions provided for in Titles III and IV with a view to enforcing this decision imposing an obligation to leave French territory, may, within a period of forty-eight hours following notification of the decision to assign him/her to residence or to place him/her in detention, apply to the president of the administrative court to suspend enforcement of the decision imposing an obligation to leave French territory.

Lorsque la décision portant obligation de quitter le territoire français, notifiée antérieurement à la décision de l’Office français de protection des réfugiés et apatrides, est devenue définitive, l’étranger qui fait l’objet, postérieurement à la décision de l’office, d’une assignation à résidence, ou d’un placement en rétention administrative dans les conditions prévues aux titres III et IV en vue de l’exécution de cette décision portant obligation de quitter le territoire français, peut, dans un délai de quarante-huit heures suivant la notification de la décision d’assignation à résidence ou de placement en rétention, demander au président du tribunal administratif de suspendre l’exécution de la décision portant obligation de quitter le territoire français.
