Article L814-5 of the French Commercial code

The court-appointed administrator not registered on the national list, appointed under the conditions provided for in the second paragraph of Article L. 811-2, the judicial representative not on the national list, appointed under the conditions provided for in the first paragraph of II of article L. 812-2 or by III of this same article, must provide evidence, when accepting their assignment, of a guarantee allocated to the reimbursement of funds, effects or securities as well as insurance taken out with the guarantee fund, where applicable. This insurance covers the pecuniary consequences of the civil liability incurred by this court-appointed administrator or this court-appointed agent, due to his negligence or misconduct or that of his employees, committed in the exercise of his mandate.

L’administrateur judiciaire non inscrit sur la liste nationale, désigné dans les conditions prévues par le deuxième alinéa de l’article L. 811-2, le mandataire judiciaire non inscrit sur la liste nationale, désigné dans les conditions prévues par le premier alinéa du II de l’article L. 812-2 ou par le III de ce même article, doit justifier, lorsqu’il accepte sa mission, d’une garantie affectée au remboursement des fonds, effets ou valeurs ainsi que d’une assurance souscrite le cas échéant auprès de la caisse de garantie. Cette assurance couvre les conséquences pécuniaires de la responsabilité civile encourue par cet administrateur judiciaire ou ce mandataire judiciaire, du fait de ses négligences ou de ses fautes ou de celles de ses préposés, commises dans l’exercice de son mandat.
