Article LO1113-7 of the French General Code of Local Authorities

The Government, acting by means of a decree in the Council of State, authorises, on the basis of the fourth paragraph of Article 72 of the Constitution, local and regional authorities to derogate, on an experimental basis, from the regulatory provisions governing the exercise of their powers. This decree contains the details mentioned in article LO 1113-1.

Territorial authorities may decide to participate in the experimentation provided for by the decree mentioned in the preceding paragraph, under the conditions and according to the procedures defined in Article LO 1113-2. The decision taken in application of the first sentence of the present paragraph may be appealed to the representative of the State under the conditions laid down in article LO 1113-3. The acts of a territorial authority derogating from the regulatory provisions are subject to the regime defined in article LO 1113-4. The decree in Council of State referred to in the first paragraph specifies the procedures for evaluating the measures taken on the basis of the authorisation.

The Government shall send Parliament a report on the evaluations thus carried out.

The experiment may not be continued beyond the expiry of the period mentioned in the decree in Council of State which authorised it, if it has not been the subject, by decree in Council of State, of one of the measures provided for in the second to fourth paragraphs of Article LO 1113-6.

Le Gouvernement, agissant par voie de décret en Conseil d’Etat, autorise, sur le fondement du quatrième alinéa de l’article 72 de la Constitution, les collectivités territoriales à déroger, à titre expérimental, aux dispositions réglementaires régissant l’exercice de leurs compétences. Ce décret contient les précisions mentionnées à l’article LO 1113-1.

Les collectivités territoriales peuvent décider de participer à l’expérimentation prévue par le décret mentionné à l’alinéa qui précède, dans les conditions et selon les procédures définies à l’article LO 1113-2. La délibération prise en application de la première phrase du présent alinéa peut faire l’objet d’un recours du représentant de l’Etat dans les conditions prévues à l’article LO 1113-3. Les actes d’une collectivité territoriale dérogeant aux dispositions réglementaires sont soumis au régime défini à l’article LO 1113-4. Le décret en Conseil d’Etat mentionné au premier alinéa précise les modalités d’évaluation des dispositions prises sur le fondement de l’autorisation.

Le Gouvernement adresse au Parlement un bilan des évaluations auxquelles il est ainsi procédé.

L’expérimentation ne peut être poursuivie au-delà de l’expiration du délai mentionné par le décret en Conseil d’Etat qui l’avait autorisée, si elle n’a fait l’objet, par décret en Conseil d’Etat, de l’une des mesures prévues aux deuxième à quatrième alinéas de l’article LO 1113-6.
