Article LO6461-13 of the French General Code of Local Authorities

The Territorial Council is consulted by the Minister responsible for Overseas Territories on proposals for acts of the European Community and the European Union taken in application of the stipulations of the treaties relating to the European Union and the European Community applicable to Saint-Pierre-et-Miquelon, which have a particular impact on the situation of the archipelago.

The opinion of the Territorial Council is deemed to have been obtained within one month of the referral. This period is reduced to fifteen days in urgent cases at the request of the representative of the State.

The Territorial Council may submit proposals to the Government for the application to Saint-Pierre-et-Miquelon of the treaties relating to the European Union and the European Community.

Le conseil territorial est consulté par le ministre chargé de l’outre-mer sur les propositions d’actes de la Communauté européenne et de l’Union européenne pris en application des stipulations des traités relatifs à l’Union européenne et à la Communauté européenne applicables à Saint-Pierre-et-Miquelon, qui ont des incidences particulières sur la situation de l’archipel.

L’avis du conseil territorial est réputé acquis dans un délai d’un mois à compter de la saisine. Ce délai est réduit à quinze jours en cas d’urgence sur demande du représentant de l’Etat.

Le conseil territorial peut adresser au Gouvernement des propositions pour l’application à Saint-Pierre-et-Miquelon des traités relatifs à l’Union européenne et à la Communauté européenne.
