Article R111-1 of the French Consumer Code

For the purposes of 1° and 3° to 6° of article L. 111-1, the trader shall provide the consumer with the following information:

1° His name or company name, the geographical address of his establishment and, if different, that of his registered office, his telephone number and his e-mail address;

>The terms of payment, the conditions of use and the conditions of the contract
2° The arrangements for payment, delivery and performance of the contract and the arrangements made by the trader for dealing with complaints;

>The existence and terms and conditions of the contract and the arrangements made by the trader for dealing with complaints
3° The existence of and procedures for implementing the legal guarantee of conformity referred to in articles L. 217-3 et seq. and articles L. 224-25-12 et seq. of the Consumer Code, the legal guarantee against hidden defects referred to in articles 1641 to 1649 of the Civil Code or any other applicable legal guarantee;

> 4° The existence of and procedures for implementing the legal guarantee against hidden defects referred to in articles 1641 to 1649 of the Civil Code or any other applicable legal guarantee;

4° The existence of and procedures for implementing the commercial guarantee referred to in articles L. 217-21 et seq. and the after-sales service referred to in articles L. 217-25 et seq.
5° Where applicable, the duration of the contract or, in the case of an open-ended or tacitly renewable contract, the conditions under which it may be terminated;

> Where applicable, the duration of the contract or, in the case of an open-ended or tacitly renewable contract, the conditions under which it may be terminated
6° Where applicable, the functionalities of the digital content, including any applicable technical protection measures, as well as any relevant compatibility and interoperability with certain goods, digital content or digital services and with certain hardware or software, of which the professional is or ought reasonably to be aware;

>The contact details of the mediator(s) responsible for the dispute
7° The contact details of the consumer ombudsman or ombudsmen to whom he is answerable in accordance with article L. 616-1.

For the application of 3° and 4°, the trader uses, respectively, the terms “legal guarantee” and the terms “commercial guarantee” when he offers the latter in addition to the legal guarantees.

Pour l’application des 1° et 3° à 6° de l’article L. 111-1, le professionnel communique au consommateur les informations suivantes :


1° Son nom ou sa dénomination sociale, l’adresse géographique de son établissement et, si elle est différente, celle du siège social, son numéro de téléphone et son adresse électronique ;


2° Les modalités de paiement, de livraison et d’exécution du contrat ainsi que celles prévues par le professionnel pour le traitement des réclamations ;


3° L’existence et les modalités de mise en œuvre de la garantie légale de conformité mentionnée aux articles L. 217-3 et suivants et aux articles L. 224-25-12 et suivants du code de la consommation, de la garantie légale des vices cachés mentionnée aux articles 1641 à 1649 du code civil ou de toute autre garantie légale applicable ;


4° L’existence et les modalités de mise en œuvre de la garantie commerciale mentionnée aux articles L. 217-21 et suivants et du service après-vente mentionné aux articles L. 217-25 et suivants ;


5° S’il y a lieu, la durée du contrat ou, s’il s’agit d’un contrat à durée indéterminée ou à tacite reconduction, les conditions de sa résiliation ;


6° S’il y a lieu, les fonctionnalités du contenu numérique, y compris les mesures de protection technique applicables, ainsi que toute compatibilité et interopérabilité pertinentes avec certains biens, contenus numériques ou services numériques ainsi qu’avec certains matériels ou logiciels, dont le professionnel a ou devrait raisonnablement avoir connaissance ;


7° Les coordonnées du ou des médiateurs de la consommation dont il relève conformément à l’article L. 616-1.


Pour l’application des 3° et 4°, le professionnel utilise, respectivement, les termes de “ garantie légale ” et les termes de “ garantie commerciale ” lorsqu’il propose cette dernière en sus des garanties légales.
