Cancellation of an insurance contract under article L. 113-16 is effected in one of the ways provided for in article L. 113-14, if cancellation is initiated by the insured, or by sending a registered letter with acknowledgement of receipt if cancellation is initiated by the insurer.
This letter or dispatch must indicate the nature and date of the event to which it refers and give all details likely to establish that the cancellation is directly related to the said event.
When the event is established or recorded by a court decision or when legal effects can only be deduced from it after homologation or exequatur, the date used is the date on which the court decision has the force of res judicata.
