Article R113-9 of the French Cinema and Moving Image Code

Contractual agents of the establishment appointed to a post in a category or class higher than that to which they belonged or to a management post are classified at a step with an index equal to or, failing that, immediately higher than that which they held in their original category or class. Within the time limit set by the decision provided for in article R. 113-11 to reach the higher step in their new category or class, they shall retain the seniority of step acquired in their previous situation, when the increase in salary following their appointment is less than or equal to that which they would have received by advancing to a higher step in their previous category or class.

Employees appointed when they have reached the highest step in their original category shall retain their seniority in that step, subject to the same conditions and limits, when the increase in salary following their appointment is less than that resulting from advancement to the latter step.

Les agents contractuels de l’établissement nommés dans un emploi d’une catégorie ou d’une classe supérieure à celle dont ils relevaient ou dans un emploi de direction sont classés à un échelon comportant un indice égal ou, à défaut, immédiatement supérieur à celui qu’ils détenaient dans leur catégorie ou classe d’origine. Dans la limite de la durée fixée par la délibération prévue à l’article R. 113-11 pour accéder à l’échelon supérieur dans leur nouvelle catégorie ou classe, ils conservent l’ancienneté d’échelon acquise dans leur précédente situation, lorsque l’augmentation de traitement consécutive à leur nomination est inférieure ou égale à celle que leur aurait procurée un avancement d’échelon dans leur ancienne catégorie ou classe.

Les agents nommés alors qu’ils ont atteint l’échelon le plus élevé de leur catégorie d’origine conservent leur ancienneté d’échelon, dans les mêmes conditions et limites, lorsque l’augmentation de traitement consécutive à leur nomination est inférieure à celle résultant d’un avancement à ce dernier échelon.
