I.-Where a programme is implemented without having been declared in advance, the Director General of the Regional Health Agency within whose jurisdiction the programme coordinator operates shall order that it no longer be implemented. The programme coordinator has thirty days from notification of this decision to declare the programme or to stop implementing it. The Director General of the Regional Health Agency may impose an administrative fine of up to 30,000 euros on the coordinator, under the conditions and in accordance with the procedures defined in articles L. 1435-7-1 and R. 1435-37, with the exception of 3° of II of the latter article, in the absence of a declaration or cessation of implementation of the programme after this period has expired.
II.-If a declared programme does not comply with one or more of the obligations set out in articles L. 1161-1 to L. 1161-4 and R. 1161-3, the Director General of the Regional Health Agency will inform the programme coordinator of the shortcomings observed and give it formal notice to rectify the situation.
The programme coordinator has thirty days from the date of notification of the formal notice to rectify the shortcomings observed. If no response is received within this period, the Director General of the Regional Health Agency will decide not to allow the programme to continue and may impose an administrative fine on the professional(s) responsible for the breach, in accordance with the conditions set out in I.
III.Where the programme is implemented in a way that is likely to endanger patients’ health, the Director General of the Regional Health Agency will give formal notice to the programme coordinator to cease implementation of the programme without delay.
If the programme is not ceased immediately, the Director General of the Regional Health Agency will decide not to allow it to continue and may impose an administrative fine under the conditions defined in I on the professional(s) responsible for the breach.
IV – In the cases provided for in I to III above, where the programme is implemented in several regions, the Director General of the relevant Regional Health Agency will inform the Directors General of the Regional Health Agencies concerned of the measures taken.
