Article R121-5 of the French Sports Code

Approval granted to a sports association or resulting from its affiliation to a sports federation approved by the State pursuant to article L. 131-8 may be withdrawn by the Prefect of the département in which its registered office is located in the event of :

1° Non-compliance of the articles of association with the conditions set out in article R. 121-3 ;

2° Serious breach by the association of its articles of association;

3° Offence against public order or public morality;

4° Failure to comply with health or safety regulations;

5° Failure to comply with the provisions of articles L. 212-1, L. 212-2, L. 212-9 and L. 322-1.

The sports association benefiting from the authorisation is informed in advance of the reasons for which the withdrawal is envisaged and given the opportunity to present written or oral observations.

L’agrément accordé à une association sportive ou résultant de son affiliation à une fédération sportive agréée par l’Etat en application de l’article L. 131-8 peut être retiré par le préfet du département de son siège en cas de :

1° Non-conformité des statuts avec les conditions posées par l’article R. 121-3 ;

2° Violation grave, par l’association, de ses statuts ;

3° Atteinte à l’ordre public ou à la moralité publique ;

4° Méconnaissance des règles d’hygiène ou de sécurité ;

5° Méconnaissance des dispositions des articles L. 212-1, L. 212-2, L. 212-9 et L. 322-1.

L’association sportive bénéficiaire de l’agrément est préalablement informée des motifs pour lesquels le retrait est envisagé et mise à même de présenter des observations écrites ou orales.
