Article R1221-12 of the French Labour Code

At the request of any of the enforcement officers referred to in article L. 8271-7, the employer :

1° Present the notice of receipt of the pre-employment declaration if they are still required to keep it pursuant to article R. 1221-8;

2° As long as he has not received the notice of receipt, provides the information enabling them to check that he has indeed made the declaration prior to hiring the employee.

Sur toute demande des agents de contrôle mentionnés à l’article L. 8271-7, l’employeur :


1° Présente l’avis de réception de la déclaration préalable à l’embauche s’il est encore tenu de le conserver en application de l’article R. 1221-8 ;


2° Communique, tant qu’il n’a pas reçu l’avis de réception, les éléments leur permettant de vérifier qu’il a bien procédé à la déclaration préalable à l’embauche du salarié.
