Article R1231-3 of the French Public Health Code

Consent to cross-donation, where applicable, is recorded in writing. It is signed by the judge and by the donor.

If the magistrate considers that the removal must be authorised by the committee of experts pursuant to the second paragraph of IV of article L. 1231-1, he or she shall mention this fact in the instrument of consent.

The original of the instrument of consent is kept at the court registry. A copy is sent to the donor and to the doctor in charge of the service, department or care structure of the health establishment in which the removal is envisaged, who forwards it to the director of the establishment.

L’acte par lequel est recueilli le consentement, le cas échéant à un don croisé est dressé par écrit. Il est signé par le magistrat et par le donneur.

Lorsque le magistrat estime que le prélèvement doit être autorisé par le comité d’experts en application du deuxième alinéa du IV de l’article L. 1231-1, il en fait mention dans l’acte par lequel est recueilli le consentement.

La minute de l’acte par lequel est recueilli le consentement est conservée au greffe du tribunal. Une copie en est adressée au donneur et au médecin responsable du service, du département ou de la structure de soins de l’établissement de santé dans lequel le prélèvement est envisagé, qui la transmet au directeur de l’établissement.
