Article R1233-25-1 of the French General Code of Local Authorities

The commission comprises nine full staff representatives and an equal number of alternate staff representatives.

Each trade union organisation sitting on the social committee of the administration appoints, to sit on this commission, a number of full representatives equal to the number of seats it holds on this committee. They are chosen from among the full and alternate representatives on this committee.

The alternate representatives are freely appointed by the trade union organisations and must meet the eligibility conditions laid down:

1° By article 31 of the above-mentioned decree of 20 November 2020 for the agents mentioned in 1° and 2° of I of article L. 1233-5 of this code;

2° Par l’article L. 2314-19 of the Labour Code for employees mentioned in 3° of I of Article L. 1233-5 of this Code.

These appointments are made within fifteen days of the proclamation of the elections to the social administration committee.

La commission comprend neuf représentants du personnel titulaires et un nombre égal de représentants du personnel suppléants.

Chaque organisation syndicale siégeant au comité social d’administration désigne, pour siéger au sein de cette commission, un nombre de représentants titulaires égal au nombre de sièges qu’elle détient dans ce comité. Ils sont choisis parmi les représentants titulaires et suppléants de ce comité.

Les représentants suppléants sont désignés librement par les organisations syndicales et doivent satisfaire aux conditions d’éligibilité fixées :

1° Par l’article 31 du décret du 20 novembre 2020 mentionné ci-dessus pour les agents mentionnés aux 1° et 2° du I de l’article L. 1233-5 du présent code ;

2° Par l’article L. 2314-19 du code du travail pour les salariés mentionnés au 3° du I de l’article L. 1233-5 du présent code.

Ces désignations interviennent dans un délai de quinze jours à compter de la proclamation des élections au comité social d’administration.
