Insurance policies covering civil liability risks must provide that, with regard to this cover, no forfeiture on the grounds of a breach by the insured of its obligations committed subsequent to the loss will be enforceable against injured parties or their beneficiaries. They must not contain any clause prohibiting the insured from calling the insurer into question or invoking it as guarantor in connection with the settlement of a claim.
Policies of insurance against accidents at work must specify that the insurer may not invoke any forfeiture of rights against the victims or their dependants.
