Article R1251-19 of the French Labour Code

The guarantee commitment is the subject of a written contract specifying the conditions and the amount of the guarantee granted as well as the terms and conditions of the accounting control that the guarantor may exercise over the temporary employment undertaking.

This contract provides for the waiver by the guarantor, in the event of default by the temporary employment undertaking, of the benefit of discussion provided for in articles 2305 and 2305-1 of the Civil Code.

The contract is kept available at the temporary work agency’s head office for inspection by the labour inspectorate and by the inspectors of the social security bodies and social institutions.

L’engagement de caution fait l’objet d’un contrat écrit précisant les conditions et le montant de la garantie accordée ainsi que les modalités du contrôle comptable que le garant peut exercer sur l’entreprise de travail temporaire.


Ce contrat prévoit la renonciation du garant, en cas de défaillance de l’entreprise de travail temporaire, au bénéfice de discussion prévu aux articles 2305 et 2305-1 du code civil.


Le contrat est tenu, au siège de l’entreprise de travail temporaire, à la disposition de l’agent de contrôle de l’inspection du travail et des agents de contrôle des organismes de sécurité sociale et des institutions sociales.
