The Banque de France cancels the declaration of a payment incident at the request of the drawee in the following cases:
1° When the refusal to pay or the issuing of the non-payment advice note is the result of an error by the drawee ;
2° When it is established by the account holder that an event not attributable to one of the persons authorised to draw cheques on the account has led to the disappearance of the funds.
The cheque-writing ban implemented by the drawee then ceases to have effect.
The Banque de France notifies the drawee that it has cancelled the cheque. The drawee must inform its customer and complete the record provided for in article R. 131-12 by mentioning the cancellation and its cause.
If the account holder asks the drawee to apply the procedure provided for in this article, the drawee must inform the Banque de France no later than the tenth business day following the request. He shall notify his customer within the same period. If the drawee remains silent at the end of this period, the request is deemed to have been refused.
