Article R131-40 of the French Sports Code

I. – The personal information relating to gambling operations recorded by an online gaming or betting operator held by the Autorité Nationale des Jeux, to which a delegated sports federation may have access, concerns the players:

1° A sporting competition organised by the federation concerned;

2° A sporting competition organised by the professional league set up by that federation;

3° A sporting event referred to in article L. 331-5 ;

4° Holders of a sports licence within the meaning of article L. 131-6 and taking part in an international competition.

When the competitions mentioned in 2° and 3° are the subject of sports betting, the professional leagues and the natural or legal persons governed by private law mentioned in article L. 331-5 are required to send the delegating federations the information provided for in 1°, 2° and 3° of article R. 131-38.

II. – The personal information relating to players and their gambling activities mentioned in II of Article R. 131-38-1 and held by La Française des jeux, to which a delegating sports federation may have access, concerns the players mentioned in 1° to 4° of I.

Article R131-40

I. – Les informations personnelles relatives à des opérations de jeu enregistrées par un opérateur de jeux ou de paris en ligne détenues par l’Autorité nationale des jeux, auxquelles une fédération sportive délégataire peut avoir accès, concernent les acteurs :

1° D’une compétition sportive organisée par la fédération concernée ;

2° D’une compétition sportive organisée par la ligue professionnelle que cette fédération a constituée ;

3° D’une manifestation sportive mentionnée à l’article L. 331-5 ;

4° Titulaires d’une licence sportive au sens de l’article L. 131-6 et participant à une compétition internationale.

Lorsque les compétitions mentionnées aux 2° et 3° font l’objet de paris sportifs, les ligues professionnelles et les personnes physiques ou morales de droit privé mentionnées à l’article L. 331-5 sont tenues de transmettre aux fédérations délégataires les informations prévues aux 1°, 2° et 3° de l’article R. 131-38.

II. – Les informations personnelles relatives aux joueurs et à leurs prises de jeu mentionnées au II de l’article R. 131-38-1 et détenues par la société La Française des jeux, auxquelles une fédération sportive délégataire peut avoir accès, concernent les acteurs mentionnés aux 1° à 4° du I.
