Article R132-5-1 of the French Insurance Code

The agreements referred to in Article L. 132-28 shall be drawn up in writing at the request of the intermediaries and shall provide in particular for:

1° The insurance intermediary shall:

a) Submit to the insurance undertaking any draft advertising document drawn up by the intermediary, irrespective of the medium used, and any changes that the intermediary intends to make to the document, prior to its distribution;

b) Comply with the obligation to use only advertising documents approved by the insurance undertaking;

2° The insurance undertaking shall:

a) Verification that any draft or amended advertising document relating to the contract and drawn up by the intermediary complies with the insurance or capitalisation contract, within a period set by the agreement;

b) Systematic transmission and updating, in particular in the form of presentation sheets, of the information required to assess all the characteristics of the contract, both by the intermediary and by customers; this information is available on paper or any other durable medium.

Article R132-5-1

Les conventions mentionnées à l’article L. 132-28 sont établies par écrit à la demande des intermédiaires et prévoient notamment :

1° A la charge de l’intermédiaire d’assurance :

a) La soumission à l’entreprise d’assurance de tout projet de document à caractère publicitaire qu’il a établi, quel que soit son support, et de toute modification qu’il entend apporter à ce document, préalablement à sa diffusion ;

b) L’obligation de n’utiliser que les documents à caractère publicitaire approuvés par l’entreprise d’assurance ;

2° A la charge de l’entreprise d’assurance :

a) La vérification de la conformité au contrat d’assurance ou de capitalisation de tout projet ou modification de document à caractère publicitaire relatif à ce contrat et établi par l’intermédiaire, dans un délai fixé par la convention ;

b) La transmission et la mise à jour systématique, notamment sous forme de fiches de présentation, des informations nécessaires à l’appréciation de l’ensemble des caractéristiques du contrat, tant par l’intermédiaire que par la clientèle ; ces informations sont disponibles sur support papier ou tout autre support durable.
