Article R132-5-2 of the French Insurance Code

I. – The agreements provided for in article L. 132-28 are not required if the intermediary only uses advertising documents provided by the insurance company and the latter has undertaken in writing to send him the information mentioned in b of 2° of article R. 132-5-1.

II – Such an agreement is not required in the case of the marketing of contracts mentioned in article L. 441-1 where the relationship between the member and the policyholder makes membership of the contract compulsory.

I. ― Les conventions prévues à l’article L. 132-28 ne sont pas exigées dès lors que l’intermédiaire n’a recours qu’aux documents à caractère publicitaire mis à sa disposition par l’entreprise d’assurance et que celle-ci s’est engagée par écrit à lui transmettre les informations mentionnées au b du 2° de l’article R. 132-5-1.


II. ― L’établissement d’une telle convention n’est pas exigé en cas de commercialisation des contrats mentionnés à l’article L. 441-1 lorsque le lien qui unit l’adhérent au souscripteur rend obligatoire l’adhésion au contrat.
